OverHerd Privacy Policy

Last Updated: March 19, 2025

This Privacy Policy explains how OverHerd Inc ("OverHerd," "we," "us," or "our") collects, uses, shares, and protects information in relation to our website, mobile application, and related services (collectively, the "Service").

By using our Service, you agree to the collection and use of information in accordance with this Privacy Policy. We will not use or share your information with anyone except as described in this Privacy Policy.

1. Information We Collect

1.1 Information You Provide to Us

While OverHerd allows anonymous posting, we may collect certain information that you provide directly to us when you:

  • Create an account
  • Set up your profile
  • Communicate with us or other users
  • Request customer support

This information may include:

  • Email address (if provided)
  • Device information
  • Account credentials

1.2 Information We Collect Automatically

When you access or use our Service, we automatically collect certain information, including:

  • Device Information: Information about your device, including IP address, device type, operating system, browser type, mobile network information, and device identifiers.
  • Usage Information: Information about your activity on our Service, including the content you view, your interactions with other users, your browsing history on our Service, and the time, frequency, and duration of your activities.
  • Location Information: With your permission, we may collect precise or approximate location information from your device. This is essential for our location-based "herds" feature. You can control this through your device settings.
  • Information from Cookies and Similar Technologies: We and our third-party partners may use cookies, web beacons, and other tracking technologies to collect information about your browsing activities within our Service.

1.3 Information from Blockchain

Because OverHerd is built on the Sei blockchain, all content posted to the Service is stored on-chain and is publicly accessible. This includes:

  • Posts
  • Comments
  • Votes and other interactions

It is important to understand that information recorded on a public blockchain is immutable and may remain there indefinitely.

2. How We Use Your Information

We use the information we collect to:

  • Provide, maintain, and improve our Service
  • Create and maintain your account
  • Develop new features and services
  • Send you technical notices, updates, security alerts, and administrative messages
  • Respond to your comments, questions, and customer service requests
  • Facilitate the connection to location-based herds
  • Monitor and analyze trends, usage, and activities in connection with our Service
  • Detect, investigate, and prevent fraudulent transactions and other illegal activities
  • Protect the rights, privacy, safety, or property of OverHerd and our users

3. How We Share Your Information

We may share the information we collect in the following ways:

3.1 With Other Users

When you use the Service, certain information may be visible to other users:

  • Content you post is visible to users with access to the relevant "herds"
  • Your approximate location may be used to determine which local "herds" you can access

3.2 With Third-Party Service Providers

We may share information with third-party vendors, consultants, and other service providers who need access to such information to carry out work on our behalf. These include:

  • Cloud service providers
  • Analytics providers
  • Customer support services

3.3 For Legal Reasons

We may share information if we believe in good faith that disclosure is necessary to:

  • Comply with applicable laws, regulations, legal processes, or governmental requests
  • Enforce our Terms of Service and other agreements, including investigation of potential violations
  • Detect, prevent, or otherwise address fraud, security, or technical issues
  • Protect the rights, property, or safety of OverHerd, our users, or the public as required or permitted by law

3.4 In Connection with a Business Transaction

If we are involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of corporate assets, information we collect may be transferred as part of that transaction.

4. Blockchain Data

4.1 Public Nature of Blockchain

OverHerd stores all content 100% on-chain on the Sei blockchain. By using our Service and posting content, you acknowledge that:

  • All content posted to the Service is stored on a public blockchain
  • Content stored on the blockchain is immutable and cannot be deleted
  • Anyone can view the content and data stored on the Sei blockchain without using the OverHerd Service

4.2 Limitations on Deletion

Due to the immutable nature of blockchain technology, we cannot delete content that has been recorded on-chain. Even if we disable access to content through our Service, the information may still exist on the Sei blockchain.

5. Your Choices

5.1 Account Information

You may update or correct information about yourself at any time by accessing your account settings within the Service. If you wish to delete your account, you may do so through the Service; however, note that we may retain certain information as required by law or for legitimate business purposes, and on-chain data cannot be deleted from the blockchain.

5.2 Location Information

You can control the Service's access to your device's location through your device settings. However, some features of the Service, particularly the location-based "herds," require location information to function properly.

5.3 Cookies

Most web browsers are set to accept cookies by default. If you prefer, you can usually set your browser to remove or reject cookies. Note that removing or rejecting cookies may affect the availability and functionality of our Service.

5.4 Push Notifications

You can opt out of receiving push notifications through your device settings. Doing so will not affect your use of the Service, but you may miss updates about your local "herd" or interactions with your content.

6. Analytics and Advertising

We may use third-party analytics services to help understand your usage of our Service. These services collect information sent by your device or our Service and use that information to provide analysis of Service usage. We may also work with third-party partners to provide you with relevant advertising both within and outside the Service.

7. Data Security

We take reasonable measures to help protect information about you from loss, theft, misuse, unauthorized access, disclosure, alteration, and destruction. However, no Internet or electronic communications transmission is ever fully secure or error-free. In particular, information posted to a blockchain is inherently public and cannot be made private once published.

8. Children's Privacy

Our Service is not directed at children under the age of 16. We do not knowingly collect personal information from children under 16. If you are a parent or guardian and you learn that your child has provided us with personal information, please contact us at support@overherd.xyz.

9. International Data Transfers

We may transfer, process, and store information about you on servers located in various countries, including outside your country of residence, where data protection laws may differ from those of your country.

10. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page and updating the "Last Updated" date at the top. You are advised to review this Privacy Policy periodically for any changes. Changes to this Privacy Policy are effective when they are posted on this page.

Your continued use of the Service after we post any modifications to the Privacy Policy will constitute your acknowledgment of the modifications and your consent to abide and be bound by the modified Privacy Policy.
